Candidate confirmation and consent form for personal data processing

JACCS International Vietnam Finance Co., Ltd. promulgates the Terms and Conditions for Processing Candidate Personal Data (hereinafter referred to as the “Document”) in order to provide Candidates with complete, transparent information and comply with the provisions of the law on personal data protection in recruitment activities at JIVF with the following contents.

Article 1. Explanation of terminology 

1.  JIVF or Company: JACCS International Vietnam Finance Co., Ltd.;

2.  Candidates: those who apply for vacancies at JIVF;

3.  Personal data: means digital data or other forms of information that identify or help identify a specific person, including: Basic Personal Data and Sensitive Personal Data;

4.  Basic personal data: is personal data reflecting common personal and background factors, often used in transactions and social relationships, including:

a. Full name, middle name and birth name, other names (if any);

b. Date of birth; date of death or disappearance;

c. Gender;

d. Place of birth, place of birth registration, place of permanent residence registration, place of temporary residence registration, current residence, hometown, contact address;

e. Nationality;

f. Images of individuals;

g. Telephone number, personal identification number, passport number, driver’s license number, license plate number;

h. Marital status;

i. Information about family relationships (parents, children, spouses);

j. Information about the individual’s digital account;

k. Other information associated with a specific person or helping to identify a specific person does not fall under the provisions of Clause 5 of this Article.

5.  Sensitive personal data: is personal data associated with the privacy of individuals, when infringed upon, will directly affect the legitimate rights and interests of agencies, organizations and individuals, including:

a. Data revealing racial and ethnic origins;

b. Views on politics, religion and belief;

c. Information about private life, personal secrets, family secrets;

d. Health status;

e. Biometric data, genetic characteristics;

f. Data revealing the sex life and sexual orientation of individuals;

g. Data on crimes and violations of law collected and stored by law enforcement agencies;

h. The individual’s location is determined through location services;

i. Information on usernames and passwords to access electronic identification accounts of individuals; images of identity cards, citizen identity cards, identity cards;

j. Username and password of the bank account; bank card information, data on transaction history of bank accounts; financial and credit information and information on activities and history of financial, securities and insurance transactions of customers at credit institutions, foreign bank branches, payment intermediary service providers, securities, insurance, and other licensed organizations;

k. Data to track behaviors and activities of using telecommunications services, social networks, online communication services and other services in cyberspace;

l. Other personal data required by law to be kept confidential or strict security measures are required.

6.  Relevant Persons: are individuals who have a direct or indirect relationship with the Candidate, in the following cases: family members (grandparents, spouses, fathers, mothers, children, brothers/sisters, grandchildren, aunts, uncles), references, recommenders:

7.  Transaction channels: are the official communication methods announced and used by JIVF to provide information, notify and exchange with Candidate, including but not limited to: JIVF’s official website; email addresses, phone numbers; recruitment platform systems managed or operated by JIVF:

Article 2. Roles of the Parties

1.  To the extent of this Document, the Candidate agrees and cknowledges that JIVF is the controller and processor of the Candidate’s Personal Data during the recruitment process.

2.  In the event that the Candidate provides JIVF with the Personal Data of Relevant Person for the purposes of Article 3 of this Document, the Candidate understands and agrees that this Document is also an agreement on the processing of Personal Data between (i) the Candidate as the controller of the Personal Data or the controller and processor of the Data individually, subject to the agreement between the Candidate and Relevant Person and (ii) JIVF as the processor of the Personal Data. Accordingly, the Candidate commits and guarantees:

a. JIVF has the full right to process the Personal Data of Relevant Person such as the Candidate’s own Personal Data;

b. The Candidate has notified and obtained the Relevant Person’s consent that the Candidate provides the Relevant Person’s Personal Data to JIVF for processing for the purposes of Article 3 of this Document. The burden of proving consent in this case rests with Candidate and Candidate shall provide evidence to the JIVF at any time requested by the JIVF;

c. The Candidate shall notify JIVF of Relevant Person’s request to withdraw consent to the processing of Personal Data, restrict, object, view, correct, delete, destroy his/her Personal Data within 1 day from the date Candidate receives the request. In case the Candidate’s failure to notify leads to JIVF’s delay in implementing Relevant Person’s request, JIVF shall not be affected by any complaint from Relevant Person;

d. In the event of a dispute between the Candidate and Relevant Person regarding the protection of Personal Data through no fault of JIVF, JIVF shall not be affected and shall not be liable to the competent authority, Relevant Person or a third party for the Candidate’s violations.

Article 3. Purposes of Processing Candidate’s Personal Data

Within the scope of this Document, Candidate agrees to allow JIVF to carry out the processing of Personal Data for the following purposes:

1.  Implement JIVF’s recruitment process

a. Evaluate the validity of the Candidate’s application;

b. Assess the Candidate’s suitability for the position for which the Candidate is applying;

c. Verification of the Candidate’s education, occupation and experience;

d. Carry out the procedures according to the Candidate’s recruitment process including: receiving, evaluating, interviewing, selecting and signing labor contracts with Candidates;

e. Maintain contact, contact, arrange interviews and inform Candidates of suitable job opportunities;

f. Manage personnel records; establish and build a database on Candidates and store personal records and information related to the Candidate’s recruitment participation process;

g. Providing information, meeting the requirements of competent state agencies, organizing audits, inspections and investigations in accordance with law; fulfill requirements and obligations on declaration, registration and reporting to competent state agencies.

2.  Detection, investigation and prevention of criminal acts

a. Prepare and send reports and provide them to competent state agencies in order to detect, investigate and prevent acts of fraud, fraud and criminal offenses;

b. Taking measures to examine and verify information by comparing it with the Government’s databases or other official centralized databases in accordance with law;

c. Conduct checks against third-party fraud prevention databases of the Government and non-governmental parties as well as other financial crime prevention databases to prevent acts of money laundering, terrorism, fraud and other financial crimes,  to ensure that the recruitment of Candidate complies with the provisions of the law, ensuring the safety of JIVF;

d. Recognition of any fraud or money laundering risk will be kept by fraud prevention organizations, and this may cause other parties to refuse to provide services to the Candidate or refuse to recruit the Candidate.

Article 4. Personal Data of Candidates that JIVF collects and processes

Within the scope of this Document, Candidate agrees to allow JIVF to collect and process the following types of Personal Data.

1.  JIVF may collect various types of basic Personal Data below:

a. Personal data – information that allows the Candidate to be identified, e.g. full name, date of birth, place of birth, photograph of the Candidate and other identification data, including identification data such as citizen identification number, personal identification number, passport number, tax identification number, social insurance code and health insurance card number;

b. Contact data – information that allows the transmission, sending or exchange of a message/message to the Candidate. For example: email address, mobile phone number, address where he used to work, place of permanent residence registration, place of temporary residence registration, current residence, hometown, contact address of the Candidate;

c. Professional data – information about the Candidate’s learning process and work experience;

d. Personal relationship data – information about the affiliation or close relationships between individuals or legal entities through which the Candidate’s identity can be determined. For example, the relationship with the reference person where he used to work, marital status, relationship with family members in accordance with the law.

2.  In some vacancies, JIVF may need to collect Candidates’ Sensitive Personal Data or as permitted by law. This sensitive personal data (sometimes also referred to as special category personal data) may include:

Data on criminal convictions, proceedings, or allegations – information about criminal records or information that JIVF determines to be relevant to JIVF’s crime prevention obligations. This data includes information about the alleged or convicted crime or offense.

Article 5. Processing of Candidate Personal Data

1.  Processing of Candidate Personal Data

Within the scope of this Document, Candidate agrees to allow JIVF to carry out the activities of processing the Candidate’s Personal Data for the purposes specified in Article 2 of this Document as follows: collection, analysis, aggregation, storage, encryption, decryption, correction, deletion, destruction, de-identification, providing, disclosing, transferring Personal Data and other activities affecting Personal Data in accordance with the provisions of JIVF’s laws.

2.  Processing of Personal Data Collection

JIVF will collect the Candidate’s Personal Data from the following sources:

a. Directly from the Candidate: Directly provided by the Candidate in the candidate’s application profile or interview;

b. From third parties: Services/ recruitment sites that the Candidate has applied for, companies the Candidate has worked for, Relevant Persons;

c. From lawful public information sources: Personal data is collected indirectly through legal and official public information sources; or through receiving necessary data sharing from subsidiaries and partners that they collect in the course of cooperation with JIVF within the scope of data processing purposes.

3.  Storage method and storage period

a. JIVF stores Personal Data and takes appropriate measures for security.

b. JIVF stores the Candidate’s Personal Data for a period of 02 years from the date of termination of  recruitment to fulfill the purposes stated in this Document, contracts, agreements, other documents established with the Data Subject and in accordance with the provisions of law, unless the Candidate requests the deletion of the Data earlier.

Article 6. Sharing and providing Candidate’s Personal Data

JIVF limits how and to whom JIVF shares Candidates’ Personal Data and takes steps to ensure that Candidates’ Personal Data is kept confidential and protected when JIVF shares.

Within the scope of this Document, the Candidate agrees to allow JIVF to share and provide the Candidate’s Personal Data for the purposes of processing Personal Data as stated in Article 2 of this Document with the following subjects, unless otherwise provided for by law:

1.  Within the scope of JIVF’s business divisions

2. Authorized Third Parties

– Legal guardian, any person who recommends the Candidate to the JIVF;

– Any person to whom the JIVF is authorized by the Candidate, whether manually or electronically, to share information.

3.  Third Party Verification of Candidate Information

– Credit or similar information centers (including operators of any centralized databases used by these agencies), agency credit service providers and fraud prevention organizations;

– Other non-governmental third parties perform database audits to prevent money laundering, terrorism, fraud and other financial crimes.

4.  Cooperating parties to provide services

– Professional consultants such as auditors, lawyers and valuation specialists;

– Professional service providers such as market researchers, investigators;

– Partners provide recruitment, information check or competency evaluation services.

5.  Government and law enforcement agencies

As required by law or required by any competent authority, including regulatory, administrative, supervisory, court, arbitration.

6.  Other Third Parties

– Individuals, companies, business units or organizations, as the case may be, on behalf of or related to the Candidate;

– Third parties in the event of a merger, acquisition, or divestment: if JIVF transfers (or plans to transfer) any part of JIVF’s business or assets. If the transaction is conducted, the interested party may use or disclose your personal information in the same manner as set out in this Document and then notify the Candidate of any changes it may make to how it handles the Candidate’s Personal Data.

Article 7.  Confidentiality and Disclaimer

1. The Company applies necessary technical and managerial measures to ensure data security in accordance with the provisions of law.

2. However, the Candidate understands that the Personal Data the Candidate self-discloses on the internet may be collected by third parties beyond the control of the Company. The Company is exempt from liability for risks arising from causes beyond its reasonable control.

Article 8.Rights and obligations of the Candidate

The Candidate understands and agrees to his/ her rights and obligations in relation to the processing of the Candidate’s Personal Data by JIVF, specifically as follows:

1.  Candidate’s Rights

JIVF respects the Candidate’s Personal Data, and the Candidate has the following rights in relation to the Candidate’s Personal Data:

a. Right to be informed;

b. Right to consent;

c. Right to request the provision of Personal Data – The Candidate has the right to request JIVF to provide a copy of the Personal Data and information about how JIVF uses such Personal Data during the retention period;

d. Right to view, correct or request correction of Personal Data – if the Candidate’s personal information is inaccurate, the Candidate may self-correct or request JIVF to correct it during the retention period;

e. Right to data erasure – The Candidate may request JIVF to delete his/her Personal Data and accept the risks and damages that may occur to the Candidate. However, JIVF may need certain Personal Data to complete the recruitment procedure for Candidates;

f. Right to restrict or object to data processing – The Candidate may request the JIVF to stop using the Candidate’s data or change the way JIVF uses it. However, JIVF may need certain Personal Data to carry out the recruitment procedure with the Candidate;

g. Right to complain, denounce and initiate lawsuits;

h. Right to claim compensation for damages;

i. Right to self-protection – Candidates have the right to request competent authorities or agencies, organizations and individuals related to the processing of Personal Data to take measures and solutions to protect their Personal Data in accordance with the law;

j. Right to disagree, change or withdraw consent – if JIVF asks the Candidate for consent to the use of the Candidate’s Personal Data, the Candidate may change his or her mind at any time. In addition, the Candidate understands and acknowledges that JIVF will not continue to carry out the recruitment of the Candidate without processing the Candidate’s Personal Data. Therefore, when the Candidate does not agree or withdraws his/her consent, JIVF reserves the right to terminate the employment.

The exercise of the rights set out in this clause must comply with the provisions of the law on the protection of Personal Data.

2. Candidate’s Obligations

a. Protect your Personal Data by yourself, promptly notify JIVF when it detects errors, confusion about Personal Data, or suspects that Personal Data is being compromised;

b. Provide fully and accurately your Personal Data and Relevant Persons;

c. Ensure that any Personal Data of the Relevant Person provided by the Candidate to the Company has obtained his/her lawful consent and authorization for the processing of Personal Data in accordance with the law;

d. Comply with the law on personal data protection and participate in the prevention and control of personal data infringement activities;

e. Exempt JIVF from liability for risks and incidents that may occur in the process of processing Personal Data, including but not limited to data loss due to system errors, due to objective causes beyond JIVF’s control and causing consequences,  unwanted damage.

f. Other obligations under the law on data and Personal Data.

Article 9.General Regulations1. This Document takes effect from the date of signing and continues to be effective until the expiration of the archival period specified in Article 4 of this Document, and is also a Notice of Processing of Personal Data in accordance with current laws. The Candidate commits to have read, understood and agreed to the entire content of this Document and without any conditions.

2.  This document is made for the sole purpose of regulating the processing of Personal Data in compliance with the provisions of the law. In other words, this Document has independent legal effect, is not and is not dependent on any Contract between JIVF and the Candidate.

3. The Candidate understands and agrees that this Document may be amended from time to time and notified directly to the Candidate through JIVF’s Transaction Channels and other methods prior to application. The changes and effective time will be updated at the Trading Channels and/or through other methods of JIVF. In the event that the law requires it, JIVF will seek the Candidate’s consent to such changes.

4.  The Candidate has read, understood, agreed and committed to strictly implement the terms and conditions stated in this Document. Matters not yet regulated shall be implemented in accordance with the provisions of law, guidance of competent State agencies and/or amendments and supplements to this Document from time to time.

5. If a dispute arises, the parties will actively negotiate in the spirit of goodwill and cooperation. In case of failure to negotiate, the parties have the right to request the competent authority to settle in accordance with the law.
